Terms of service.
The rules of the place, in plain words. The short version is at the top and it is the part that actually matters.
The short version
NetRacer is free, it is made by one person, and it is unfinished. Play fair and it stays yours. Cheat, fake a time, or manipulate the ladder and your account ends, permanently, at our sole discretion.
Everything below is the long version of that, plus the parts that protect the person giving you a free game.
Who you are agreeing with
NetRacer is made and operated by Alex Wilkinson in Alberta, Canada ("we", "us"). Downloading, installing, or using the game, this website, or the official servers means you accept these terms in full. If you do not accept them, do not use it.
You must be at least 13 years old to have an account. If you are under the age of majority where you live, you may only use NetRacer with the consent of a parent or guardian who accepts these terms on your behalf.
You are responsible for your own hardware, internet connection, and for any charges either of them causes you.
Your account and your driver name
You sign in with Google and choose a NetRacer driver name once. That name is permanent and cannot be changed by you or by us. Choose it as though it is the name you will have forever, because it is.
Your account is personal to you. Do not share, sell, buy, rent, gift, or otherwise transfer an account, and do not drive on one that is not yours. Accounts involved in a transfer are banned, including the account that was bought.
An account is a licence to use the service, not property. You do not own it, it has no cash value, and it cannot be inherited, assigned, or claimed by anyone else.
We deliberately hold nothing that could prove who you are: no email address, no name, no phone number. If you lose access to the Google account you signed in with, your NetRacer account is gone permanently, and no support process exists to recover it. That is a consequence of holding no personal data and it is not a defect.
You are responsible for everything done through your account.
How you are expected to behave
Do not fake a time. Every official lap is verified by re-driving the inputs you sent, so a time on the board is a lap you actually drove. Modified or third-party clients, memory editing, injected code, packet manipulation, tools that drive the car for you, tool-assisted or slowed-down runs, and submitting inputs the game did not produce live are all cheating, whether or not the verifier happens to catch a given attempt.
Do not exploit. If you find a bug that gives you an advantage the game did not intend, report it instead of building records on it. We decide what counts, and we can void times set that way.
Do not attack the service. No denial-of-service, no flooding, no interfering with other players' connections, no probing or breaking into accounts, servers, or systems, no scraping beyond ordinary play, and no reverse engineering except where the law says we cannot stop you.
Do not manipulate the ladder. No boosting, no arranged results, no accounts you or your friends control set up to feed each other times, and no account sharing to build a record.
Do not use slurs, threats, sexual harassment, or targeted abuse in chat, and do not choose a driver name designed to harass, impersonate, or offend.
Do not impersonate other players, us, or anyone else.
Content you send and content you make
Anything you type in game is yours and is your responsibility. We do not endorse it and we are not liable for it. We may moderate, filter, store, or act on it, and we are under no obligation to do any of those things consistently or at all.
Tracks and other content you create with the tools shipped in the game stay yours. By distributing them through NetRacer or asking for them to be hosted, you grant us a worldwide, non-exclusive, royalty-free, perpetual licence to host, reproduce, modify for compatibility, display, and distribute them as part of the game and its promotion. You confirm the content is yours to license and does not infringe anyone else's rights.
We may remove any content, from anyone, for any reason or none, without notice.
Suspension, bans, and termination
We may suspend or terminate any account, at any time, for any reason or for no stated reason, with or without notice, at our sole discretion. Suspected cheating does not have to be proven to a legal standard before we act.
Bans are permanent by default. There is no appeal process you are entitled to. You may make your case in the Discord, and it may be reviewed, but the decision is ours and is final.
A banned account is not deleted on request. The identifier that recognises it is retained for as long as the ban stands, because deleting an account would otherwise be the cheapest way to evade one.
Evading a ban, whether by new accounts, new hardware, proxies, or VPNs, is itself a violation, and every account involved is banned.
Termination ends your licence to use NetRacer immediately. Nothing is owed to you on termination: not your times, not your rank, not your driver name.
You may stop using NetRacer at any time. That is your only remedy if you are unhappy with it or with these terms.
The ladder and your times
Rankings, scores, medals, and verified times are computed by us and are ours to correct, recalculate, void, reset, or discard. A lap set in circumstances that make it meaningless, such as clients one person controls, an exploited bug, or a tampered server, can be voided at any time.
The scoring, the medal thresholds, and what counts toward a rank can change at any time without notice, including in ways that lower your standing. A change to the car or a track can retire the boards driven on the old one.
Your rank is a derived number, not a possession, not a currency, and not a promise. Nothing here guarantees it is accurate, that it will be preserved, or that any of it will still exist tomorrow.
Money
NetRacer is free and nothing in it is for sale. There is no store, no currency, and no way to pay us anything.
If that ever changes, these terms will be updated to cover it before anything goes on sale, and you will see the terms of a purchase before you make one.
No warranty
NetRacer is provided "as is" and "as available", free of charge, while in active development. It will contain bugs. Servers will go down. Updates will change how it plays and can retire old boards. Features will be added and removed. Progress and times can be lost.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and any warranty that the service will be uninterrupted, secure, error-free, or free of cheaters.
We are under no obligation to provide support, to maintain the service, to keep servers running, to preserve your data, or to continue offering NetRacer at all. We may modify or discontinue any part of it, permanently, at any time, without notice or liability.
Servers run by other people are not ours. What happens on them is between you and whoever runs them.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, progress, ranks, profits, goodwill, or opportunity, arising from or connected to NetRacer, whether or not we were told such damages were possible.
To the fullest extent permitted by law, our total liability for any claim connected to NetRacer is limited to the greater of the amount you actually paid us in the twelve months before the claim, or twenty Canadian dollars.
Some jurisdictions do not allow some of these exclusions. Where that is the case, the exclusions apply as far as that jurisdiction permits and no further, and nothing here limits liability that cannot lawfully be limited.
Indemnity
You agree to indemnify and hold harmless Alex Wilkinson from any claim, demand, loss, or expense, including reasonable legal fees, arising from your use of NetRacer, anything you send or make available through it, or your breach of these terms or of anyone else's rights.
Changes and disputes
These terms can change as the game does. Material changes are announced in the Discord before taking effect, and continuing to use NetRacer after that is acceptance of them. If you do not accept a change, stop using it.
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts of Alberta have exclusive jurisdiction, and you consent to that venue.
Any claim must be brought individually. You waive any right to bring or participate in a class, collective, or representative action to the extent the law allows.
Any claim connected to NetRacer must be brought within one year of when it arose, or it is permanently barred, to the extent the law allows.
If any part of these terms is unenforceable, the rest stays in force and the unenforceable part is narrowed only as far as needed. Failing to enforce something is not a waiver of it. We may assign these terms; you may not. Together with the privacy policy, this is the entire agreement between us.
We are not liable for failures caused by things outside our reasonable control, including network outages, hosting provider failures, attacks, or acts of government.
